Ok im not gonna put a bomb on another site about any gpl stuff but what you think about this:
I like to provide the some more weird tutorials and do a lot of searching for that.
And now i got a message from someone saying a phpnuke wannabe downloads site has copied some of my tutorials and added it as his content,without refering to me,or even mentioning me.
Any thoughts on that,and how to persuade this canadian to remove it or put my name under it? |

Itīs copyright infringement. I would mail him to remove this immediatly there is also a problem with duplicate content. I found parts of my own news also on another website he changed only 3 or 4 words but after I mailed him that I would also contact his webhoster he removed my news. I can find on many sites our keywords and describtion Websites without content but with Adense. This is pissing me off! My download names are optimized and I found the names also on another site.

Well for the smart ones among us its clear i think who's website im refering to...without actualy naming the site.
I saw atleast 1 where my website url is published as hitwalker.nl
The tutorials copied are:
About cookies -
Speedup computer -
Whats ddos -
Tags elements -
Virus and now -
Chmod -
Htaccess tutorial -
And a few more...
I didnt get any reply yet susann,but if nothing happens i will post it in public and maybe that helps.
I know its a big story lately about gpl stuff but that doesnt apply to this...
But if i dont get a reply ill post the website...

Your website doesn't have a content copyright. In most countries this means: no copyright no legal rights.
You should add a copyright like |

Under U.S. law, it does not have to be explicitedly copyrighted. Your work is your own, no one is allowed to steal it.
Actually.. to research this more, Netherlands (like most countries) is a part of the Berne Convention. That means like the U.S., it doesn't have to be explicitedly copyrighted.
... while you could claim copyright infringement, you'd still have to go to court to protect your rights. And depending on where they are actually hosting your content, it may be impractical to impossible to make them to remove it. |

He maild and asked me to check out the tutorials/articles myself and let him know whitch ones were mine.
I maild that to him like 15 minutes later but he didnt replied to that anymore and nothing on his site is changed. |

OK I know that was just wrong. . .
Would it do any good to solicite a attorney in the country where the abuse was taking place? i.e. if an attorney thinks they can make some money, might they take the case? You had a good idea with the public hanging, are there any companies where the abuse is taking place that you can file a report with? |

Thatīs sometimes the only way to get an answer from such people. In our community every registered member is allowed to post the name from a thief. This is helpful for others. Of course you can change a username but change the name of a registered website that isnīt easy. |

Well if he ignored your email then it's fair to assume he has no intention of doing anything about it so contacting his host seems the next logical step.
I dont think there is a lot of maintenance going on there, the forums are still at 2.10 etc
I noticed the phpnuke copyright is missing from the footer but that may be due to the theme he is using.
The Jukemox module he has looks nice as a few have mentioned needing something like that where they can create their own playlists etc, shame they removed the copyright tags from that too. |

Shure but when there's someone who doesn't have to or just neglects and others copy it from his website then you're screwed and chasing rabbits.
The Berne Convention isn't known by all those webhosting noobs and you all known how much there are. Let alone all those kids between 10 and 16 who start a website. |

he fail to say why he is publishing it without any proper credit.
anyway the dirtbag has no intention of changing anything.

He is basically saying that you compiled the documents from other copyrighted sources? And that because of this, you have no claim over copyright? but then it's ok for him to use the materials lol
So what's your next step? I'm interested in how you plan to solve this. Can you keep us posted? |

Thats basically it yes.
I allways researched a lot,gathered info etc...and created simple explained tutorials from then.
And because (as he says) im not the original author he can steal whatever the lowlife canadian wants.
So i had my work,he skips that part and grabs it,simple as that.
But i maild him back saying if he does that again he's got a war on his hands.
But we know who he is and who his friends are so im not suprised at this at all.
You can check the intro to .htaccess list,he copied it from my site complete with the design(letter style and colors) ,and the fun part is that he puts his copyright below it.
To bad i dont live in canada ,i wouldnt mind visiting him and kick his butt to the next town.
But unfortunately theres not much i can do...i did however asked a few people to watch the site and strip it a litle bit. |

Well if you CUT and pasted from one document to create your document, than I would say you commited the first infringement. But if you read the information anywhere and put it into your own words so that it is not recognizable as the original material you did nothing wrong. (i know you know this) That will be were the burden of proof lies, and basically like you said he is thumbing his nose at you.
Canada has very strict laws about this. I have a few contacts, I'll ask them some questions and see if they can point me in any direction. |

Well most info is just out in the open,but that goes for for most stuff.
Tutorials are written mostly because of peoples experiences.
But im still getting replies from him,but he a canadian lowlife .
Im not even gonna repeat what he is writing,at first he tried hard to be polite but not its a problem a nd his true nature comes out.
But thats fine,im gonna return him the favor....see if he likes that. |
