"API" for old and new themes

To customize a module I need to know if I am using an old style theme or a new style theme. Does exist a variable which let me know which kind of theme I am using?

99% of all themes are 'old' so it really depends on why you need to know the differences.
Pre *nuke 7.9 uses $banners to display banner ads where as post *nuke 7.9 and RavenNuke (tm) uses $ads.
Pre Chatserv patch themes use index=1 to show right blocks whereas post Chatserv patched themes and RavenNuke (tm) use INDEX_FILE
Some older themes that have forum templates need careful comparison to newer themes as they probably have outdated forum files.
Newer themes should be advertised as XHTML compliant.
